Welcome to EIDL Clarity ("EIDL Clarity," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of EIDLClarity.com and related pages, forms, assessments, content, and resources (collectively, the "Site").
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility and Acceptance
By using the Site, you represent that you are at least 18 years old, have legal authority to agree to these Terms, and will use the Site in compliance with applicable law.
2. Nature of EIDL Clarity
EIDL Clarity is an informational, marketing, qualification, and referral platform intended to help business owners better understand whether their SBA COVID-19 Economic Injury Disaster Loan (EIDL) circumstances may warrant further review by an independent service provider.
EIDL Clarity does not itself make loans, lend money, provide credit, forgive or discharge SBA debt, guarantee modifications or settlements, or make decisions on behalf of the U.S. Small Business Administration or the U.S. Department of the Treasury.
EIDL Clarity is not a law firm, accounting firm, tax adviser, financial adviser, or government agency. Information on the Site is general information only and is not legal, tax, accounting, investment, or financial advice.
No guaranteed outcome. Submitting an inquiry, completing an assessment, speaking with a provider, or using information from the Site does not guarantee eligibility for any program or any particular result, including forgiveness, discharge, settlement, restructuring, modification, payment reduction, or relief from an SBA obligation.
3. No Government Affiliation or Endorsement
EIDL Clarity is a private website. It is not affiliated with, endorsed by, sponsored by, or acting on behalf of the U.S. Small Business Administration (SBA), the U.S. Department of the Treasury, or any other federal, state, or local government agency.
References to the SBA, EIDL program, Treasury, or other government programs or agencies are provided only to identify the subject matter being discussed.
4. Qualification Assessments and Information You Provide
The Site may ask you to provide information about your business and EIDL situation so that your inquiry can be evaluated or routed appropriately. You agree to provide information that is accurate and complete to the best of your knowledge.
Do not submit Social Security numbers, bank account numbers, credit card numbers, login credentials, or other sensitive information unless a specific, secure process expressly requests it and explains why it is required.
Submission of information does not create a professional relationship and does not obligate EIDL Clarity or any provider to accept your matter.
5. Referrals, Third-Party Providers, and Compensation
If you request assistance or complete a qualification process, EIDL Clarity may refer or transmit your inquiry to EIDLexit and/or another independent service provider that may be able to evaluate or respond to your situation.
EIDL Clarity may receive compensation for referrals, marketing services, advertising services, lead generation, or other commercial arrangements involving third-party providers. A referral or compensation arrangement does not mean that a particular provider, service, strategy, or outcome is appropriate for you.
Any engagement you enter into with a third-party provider is governed by that provider's own agreement, disclosures, pricing, scope of services, and policies. EIDL Clarity does not control and is not responsible for a third party's professional judgment, services, pricing, representations, or performance.
6. Fees
Unless clearly disclosed before you submit an inquiry, EIDL Clarity does not charge you a fee merely to use the Site or submit a request for information or referral.
A third-party provider may charge fees if you choose to engage that provider. Any such fees should be disclosed by the provider and will be governed by your separate agreement with that provider.
7. Communications and Consent
If you provide contact information, EIDL Clarity and the provider or providers identified at the point of collection may use that information to respond to your inquiry and communicate with you as permitted by the consent language shown when you submit your information.
Where required by law, consent to receive marketing calls or text messages will be obtained separately. Consent to marketing communications is not a condition of purchasing a service. Message and data rates may apply. You may opt out using the instructions provided in the applicable communication.
8. No Professional or Attorney-Client Relationship
Use of the Site, submission of a form, or receipt of general information does not create an attorney-client, accountant-client, fiduciary, adviser-client, or other professional relationship with EIDL Clarity.
If you engage an attorney, accountant, consultant, or other professional after a referral from the Site, any professional relationship exists solely between you and that provider under the terms of your separate engagement.
9. No Promises, Guarantees, or Typical-Results Claims
We do not promise or guarantee that any person will qualify for a particular service or obtain a specific financial, legal, business, or SBA-related outcome.
Examples, testimonials, case studies, statistics, or descriptions of prior matters, if displayed on the Site, are provided for informational purposes and do not guarantee or predict the outcome of any other situation. Results depend on individual facts and circumstances and may vary materially.
10. Advertising and Third-Party Platforms
The Site may be promoted through third-party advertising platforms, including Google, Meta, Microsoft, or other services. Those companies do not sponsor, endorse, operate, or guarantee EIDL Clarity or any service provider merely because an advertisement appears on their platforms.
Your use of those platforms may also be subject to the platform's own terms and privacy policies.
11. User Responsibilities
You agree that you will:
- Provide information that is accurate and not intentionally misleading;
- Use the Site only for lawful purposes;
- Not impersonate another person or misrepresent your authority to act for a business;
- Not interfere with the operation, security, or availability of the Site;
- Not introduce malware, malicious code, or other harmful technology;
- Not scrape, crawl, harvest, or use automated tools against the Site except with our written permission;
- Not use the Site to violate the rights of EIDL Clarity, a third-party provider, or any other person or entity.
12. Intellectual Property
Unless otherwise stated, the Site's text, branding, graphics, design, images, videos, and other original content are owned by EIDL Clarity or used with permission and are protected by applicable intellectual property laws.
You may use the Site for your personal or internal business informational purposes. You may not reproduce, distribute, sell, modify, publish, or create derivative works from Site content for commercial use without prior written permission.
13. Third-Party Links and Resources
The Site may contain links to websites, scheduling tools, forms, content, or services operated by third parties. Those resources are provided for convenience and do not necessarily constitute an endorsement.
We are not responsible for the availability, security, accuracy, privacy practices, terms, products, or services of third-party websites. Your use of third-party resources is subject to their own terms and policies.
14. Privacy
Our collection, use, and sharing of information through the Site is described in our Privacy Policy. By using the Site, you acknowledge that policy.
15. Site Availability and Changes
We may modify, suspend, withdraw, or discontinue any part of the Site at any time. We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.
16. Disclaimers
To the fullest extent permitted by law, the Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
We do not warrant the accuracy, completeness, timeliness, availability, or suitability of information on the Site for your particular circumstances. You remain responsible for independently evaluating information and obtaining appropriate professional advice when necessary.
17. Limitation of Liability
To the fullest extent permitted by applicable law, EIDL Clarity and its owners, affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Site.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless EIDL Clarity and its owners, affiliates, officers, employees, contractors, and agents from claims, liabilities, losses, and reasonable costs arising from your unlawful use of the Site, your material violation of these Terms, or your violation of another person's rights.
19. Governing Law and Disputes
These Terms will be interpreted under applicable law. Any dispute concerning the Site or these Terms will be handled in a court or other forum with lawful jurisdiction, subject to any mandatory rights or procedures that apply to you.
If EIDL Clarity later adopts a specific governing-law, venue, or arbitration provision, that provision should be reviewed by legal counsel before publication.
20. Changes to These Terms
We may update these Terms from time to time. When we do, the revised Terms will be posted on this page and the "Last Updated" date will be changed.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
21. Severability and Waiver
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to enforce it later.
